Parliament? What parliament? ... Oil? Whose oil?

"The biggest ever sale of oil assets will take place today, when the Iraqi government puts 40bn barrels of recoverable reserves up for offer in London.
BP, Shell and ExxonMobil are all expected to attend a meeting at the Park Lane Hotel in Mayfair with the Iraqi oil minister, Hussein al-Shahristani.
Access is being given to eight fields, representing about 40% of the Middle Eastern nation's reserves, at a time when the country remains under occupation by US and British forces.

This deal has also triggered controversy.

Two smaller agreements have already been signed with Shell and the China National Petroleum Corporation, but today's sale will ignite arguments over whether the overthrow of Saddam Hussein was a "war for oil" that is now to be consummated by western multinationals seizing control of strategic Iraqi reserves.

Issam al-Chalabi, Iraq's oil minister between 1987 and 1990, questioned why there had been no competitive tendering for the gas-gathering contract and claimed it had gone to Shell as the spoils of war.
"Why choose Shell when you could have chosen ExxonMobil, Chevron, BG or Gazprom?" he asked. "Shell appears to be paying $4bn to get hold of assets that in 20 years could be worth $40bn. Iraq is giving away half its gas wealth and yet this work could have been done by Iraq itself."

The competitive bidding round will be Iraq’s first for licences to produce oil and gas in the oil-rich country, and is being closely watched internationally.The structure of the new deals unveiled by Mr Shahristani runs against what most western oil companies and analysts were expecting and many had feared: more “technical services contracts” based on flat fees for pumping oil. Instead, by offering extra long-term incentives to foreign investors in Iraq’s re-emergent oil sector, the Iraqi oil minister may have swept aside one of the biggest impediments to getting the country’s energy development programme back on track: persuading technically savvy western oil companies to assist."

Foreign oil companies are expected to submit bids on the 20-year contracts within six months, and Iraq’s government wants deals to be in place by next June. Only the Iraqi cabinet would review the deals and decide whether to approve them, Mr Shahristani said, bypassing the need for protracted debate in Iraq’s politically fractious parliament. “We cannot afford any more delays,” he added."

ــ(( استنادا الى الدستور العراقي فان أي عقد في العراق لا يحتاج لمصادقة مجلس النواب..وحجم العقد يمكن أن يكون بالمليارات أو الملايين.. يقوم العراق الأن ببناء موانىء بحرية وشراء طائرات بكلف تقدر بمليارات الدولارات وهي تتم بمصادقة مجلس الوزراء وبالتالي ينطبق الشىء نفسه على عقود النفط )) ـ
بأي منطق أو سند قانوني يتحدث؟؟ اللهم الا اذا كان مجلس النواب قد أعطى تخويلا مطلقا للحكومة بذلك ولم نسمع به

ردا على ما جاء بتصريح السيد وزير النفط العراقي الحالي ابين ما يلي
من المبادئ الدستورية المتفق عليها بين خبراء القانون الدستوري في العالم، انه من بين المهمات الاساسية لمجالس النواب هي
اولا ) اختيار او الموافقة على تشكيل الوزارة التي تقود السلطة التنفيذية في البلد و مراقبة تأديتها و سحب الثقة منها عند الضرورة
ثانيا ) الموافقة على اية ضرائب، رسوم او التزامات مالية على المواطنين
ثالثا ) الموافقة على اية اتفاقيات او عقود مع جهات اخرى، تخص استغلال او استثمار الثروات الطبيعية للبلد، باعتبارها استثمارا لثروة المواطنين و الاجيال المقبلة من ابناء ذلك البلد

لذلك فان تصريح السيد وزير النفط العراقي يتعارض مع الاسس التي تقوم عليها الانظمة البرلمانية ، و يخالف كل قواعد الديمقراطية
ان الشعب، و عن طريق ممثليه في البرلمان، اذا لم يكن له حق الاعتراض و منع اي استغلال لثرواته الطبيعية بالطريقة التي تضمن مصالحه و مصالح اجياله المقبلة من جهة و اذا لم يكن من حقه مراجعة عمل السلطة التنفيذية و منعها من القيام باي عمل يتعارض مع مصلحته من جهة اخرى، عند ذاك لا نرى ما يستدعي وجود النواب اللذين ينتخبهم الشعب للدفاع عن حقوقه

The legal basis for detentions stems from a single line of a 2004 UN Security Council resolution, which has been renewed every year since by agreement between the US and Iraqi governments. This resolution, which gives the legal justification for continued US military occupation, allows "internment where this is necessary for imperative reasons of security."

Detainees receive an initial review of their case before being sent to Cropper, but they are not allowed to attend it. The reviews are conducted by a panel of three US military officers. Detainees are allowed to attend later reviews, but at no point are they given access to a lawyer.

Detention operations have been a rocky road. Torture and abuse at Abu Ghraib in 2003 and 2004 received the most coverage, but thousands of prisoners living in leaky tents outside the prison's "hard site" complained of lack of medical care, indifferent and at times hostile treatment from guards, inedible food and extreme weather, including flooding. American troops even admitted at the time that they believed more than 80 percent of those detained were innocent of wrongdoing. Recently released Iraqis, as well as Iraqi officials, say that this statistic is probably still true.

... One woman has five sons inside; another has a brother who has been in US prisons since 2004. Another says this is her twelfth visit to Bucca. All say that the trip is a financial strain. One says that without her husband to support her, she has been reduced to begging. Others complain that their children are depressed and failing in school.

"Most of the visits we spend crying," says Shaimaa Jumaa. "It's not just that they keep them locked up and we don't know what they're charged with. It's that they are separated from their families."

A traitor in Baghdad, a traitor in Kabul: ... A morally enlightened citizen should refrain from supporting his own country, or more correctly his government if it chooses to do wrong and adopt policies that are manifestly immoral.

Indeed, opposing such policies is the ultimate expression of true patriotism, whereas supporting one’s country -right or wrong- reflects mindless jingoism and moral bankruptcy. This factor ultimately draws the line of distinction between civility and savagery and between enlightenment and primitiveness.

However, moral depravity occurs when citizens of a given country collaborates with foreign invaders to effect goals that are decidedly criminal and evil. Such is the case of the Iraqi government.

Nuri al Maliki, the Prime Minister of Iraq, might think that he is serving the interests of his country by allowing American imperialism to gain a permanent foothold in Iraq.

He might be tempted to argue that many countries around the world are hosting American military bases without having their respective national sovereignty compromised.

He is wrong.

First of all, Iraq is not Japan or even South Korea. The American military presence in Iraq is not designed to help the Iraqis achieve true independence, stability and prosperity.

The American occupation forces are in Iraq in order to destroy Iraq, which they have done to a large extent, torment Iraqis, and transform the land of Harun al Rashid into a virtual Zionist colony serving “ global Jewish-Zionist interests.”

Moreover, the Americans seem hell-bent on arrogating Iraqi oil by turning Iraq into a banana republic, a mere cheap market for American products.

Another important reason behind the American occupation of Iraq is to forestall the potential of Iraq becoming a threat to Zionist military supremacy once again. Otherwise, why would Mossad agents scour Iraq from north to south and from east to west to assassinate top Iraqi scientists, probably in collusion with American, Kurdish and (Iraqi) intelligence services.

In short, the United States wants to destroy or neutralize Iraq on Israel’s behalf. Wasn’t that the main factor behind the American invasion, occupation and virtual destruction of the ancient land of Mesopotamia ?
